We have been advised that the Council does not intend to apply to the High Court to challenge the Planning Inspector’s decision that the seven storey development in James Yard (behind Highams Park Station) should be allowed to go ahead.
Only the High Court can overturn the Inspector’s decision and there is only a six-week window after an appeal decision has been granted to challenge the decision in the High Court. An application to the High Court must be made before 14th March 2023 if local people wish to try and stop this overdevelopment going ahead.
We have reviewed the Inspector’s Appeal Decision and we believe that there are strong grounds to challenge this decision.
We have written to Justin Carr, who is the Assistant Director, Place Directorate, Development Management & Building Control, Economic Growth & Housing Delivery at Waltham Forest Council requesting that the Council urgently reconsider their decision and apply to the High Court to have the Inspector’s decision overturned.
For the record, we are not against redevelopment of this site but are opposed to the height and density being proposed.

We copied our letter to all members of the Council’s Planning Committee, who refused approval for this development, all local Councillors within the Highams Park Planning Group area and our local two local MP’s.
What you can do to help
If you are against the overdevelopment of this site development you may wish to email your local Councillors and you local MP, telling that you do not agree with this development proposal and ask them to request the Planning Department to challenge the Planning Inspector’s Appeal Decision in the High Court on the grounds that the Planning Inspector has misdirected herself, as she has not properly considered the policies in the Highams Park Neighbourhood Development Plan in her assessment of the impact this development will have on the character Highams Park District Centre.
